Most dangerous medicine or defective medical device cases are based upon the law of products liability. The cases are complicated and expensive. How The Cases Typically Proceed:

In most cases involving a defective medical product, hundreds or thousands of people can be affected. As such, these initial proceedings can often be consolidated into what is known as Multi-district Litigation (MDL). MDL takes all similar cases involving the same defective medical product and groups them together under the purview of one Court for initial discovery and procedural issues. This Court can be anywhere in the country. Once the cases are consolidated, a MDL judge will be assigned. That court will assign specific lawyers to different parts of the cases. By consolidating the cases for pretrial purposes, inconsistent rulings from different judges can be avoided and the discovery process can be streamlined. Once the cases are ready for trial, the parties will pick some “bellwether” cases for trial. Bellwether cases are those that are felt to be typical to the whole class of cases; therefore, the outcome of these Bellwether trials can help bring a resolution to all the claims. In other words, if the victims win all of the Bellwether cases, they will likely be able to resolve the remaining cases for a reasonable sum. The process can take a long time due to the exceedingly complex issues that arise in these types of cases, but consolidating the cases can make the process move much more smoothly.
